PharmD Live will not use or disclose PHI for marketing or sale purposes when HIPAA requires an individual’s authorization unless we obtain that authorization or another lawful basis applies.

5. PHI and healthcare arrangements

PHI is individually identifiable health information relating to an individual’s past, present, or future physical or mental health or condition, provision of healthcare, or payment for healthcare when the information is created, received, maintained, or transmitted by a HIPAA-regulated entity.[1]

PharmD Live may process PHI on behalf of a healthcare provider, health plan, or other HIPAA-covered organization. In that role, PharmD Live may act as a business associate or subcontractor. Our use and disclosure of PHI in those arrangements are governed by HIPAA, the applicable business associate agreement or other governing agreement, and the instructions of the responsible healthcare organization.[1]

Where PharmD Live processes PHI on behalf of a healthcare organization, PharmD Live uses or discloses PHI only as permitted by the applicable agreement, HIPAA, and other applicable law. PharmD Live applies the HIPAA minimum-necessary standard where it applies and limits access to PHI to authorized personnel and service providers with a legitimate need to know.

The healthcare organization responsible for an individual’s care generally remains responsible for providing its HIPAA Notice of Privacy Practices, administering patient authorizations, and responding to individual HIPAA rights requests. Individuals seeking access to or amendment of PHI, an accounting of certain disclosures, restrictions, confidential communications, or other HIPAA rights should contact the healthcare provider, health plan, or other covered entity identified in that organization’s Notice of Privacy Practices.[1]

PharmD Live will honor browser- or device-level opt-out preference signals, including Global Privacy Control signals, where required by applicable law.

PharmD Live does not intentionally permit advertising, analytics, session-replay, or similar tracking technologies to collect or receive PHI unless that use is permitted by HIPAA and other applicable law and is supported by appropriate technical and contractual safeguards. PharmD Live restricts such technologies on authenticated, scheduling, registration, symptom-related, and other healthcare-sensitive portions of the Services.[3]

7. Data retention

PharmD Live retains personal information only for as long as reasonably necessary to fulfill the purposes described in this Notice, provide the Services, maintain appropriate business and security records, resolve disputes, enforce agreements, and satisfy legal, regulatory, contractual, audit, insurance, tax, and records-retention obligations. When information is no longer required, PharmD Live will delete, de-identify, aggregate, or securely dispose of it in accordance with applicable law and our retention practices.

Retention periods vary according to the type and sensitivity of the information, the purpose of processing, applicable legal requirements, and the context of the relationship. Information may remain in backup or disaster-recovery systems until deleted or overwritten under ordinary retention cycles, subject to appropriate safeguards. PHI is retained and disposed of in accordance with applicable law and the applicable healthcare arrangement.

8. Security

PharmD Live maintains administrative, technical, physical, and organizational safeguards designed to protect personal information and PHI against unauthorized access, use, alteration, loss, or disclosure. Our safeguards are designed to include access controls, authentication measures, workforce training, vendor management, security monitoring, and incident-response processes appropriate to the nature of the information and Services involved.

No method of transmission over the internet or method of electronic storage is completely secure. We therefore cannot guarantee absolute security. Please use approved secure channels for sensitive information and notify us promptly if you believe your information or a PharmD Live account has been compromised.

You may also have the right to opt out of targeted advertising, certain profiling, or the sale or sharing of personal information where those rights apply.

HIPAA-regulated PHI and certain other information may be exempt from some state consumer privacy laws. Where HIPAA applies, individuals may have rights to inspect and obtain copies of PHI, request amendment, request certain restrictions, request confidential communications, receive an accounting of certain disclosures, obtain a Notice of Privacy Practices, and file a complaint. Those rights are generally administered by the responsible covered entity.[1]
